POPIA’S EFFECTIVE DATE RELEASED


Businesses will have 12 months from 1 July 2020 to comply with the Protection of Personal Information Act 4 of 2013 (“the Act”), according to a statement released by the President, Mr. Ramaphosa on the 22nd June 2020.

Effectively, all businesses which process personal information of both natural persons and juristic persons must comply with the Act’s 8 conditions for lawful processing by 1 July 2021.

It is important to remember that processing is very widely defined in the Act and includes the use, collection, communication, organisation, storage, deletion, transfer, dissemination, linking, copying etc. of any information that is capable of identifying a person.
